The Fair Labor Standards Act ("FLSA") requires an employer to pay most employees overtime at 1-1/2 times an employee's "regular rate" for all work in excess of 40 hours per week. In order to avoid the costs associated with FLSA compliance, employers often (mistakenly or deliberately) fail to pay proper wages and/or overtime. An employer's failure to pay proper wages or overtime can result in an award of damages equal to the unpaid wages or overtime, plus an equal amount in liquidated damages or pre-judgment interest.
